Agreement

These Terms of Use (“Terms”) govern your use of Travel Assistant - Mapia (the “App”), published by Appcelerator Studio (“we”, “us”). By downloading or using the App you agree to these Terms. If you do not agree, do not use the App.

You must be old enough to enter into this agreement where you live. If you are not, you may use the App only with the agreement of a parent or guardian, who accepts these Terms on your behalf and is responsible for what is done with the App on their device, including any purchase.

Where you downloaded the App from the Apple App Store, Apple’s Licensed Application End User License Agreement also applies, and the section “Apple” below forms part of this agreement.

License

We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, for your own use, in accordance with these Terms and the applicable app store rules.

The license is what you receive: you are not buying the App, its code, its content or any part of it. Any right not expressly granted here is reserved.

What you may not do

You agree not to:

  • Copy, modify, translate, reverse engineer, decompile, disassemble or create derivative works of the App, except where that restriction cannot be imposed under the law that applies to you.
  • Rent, lease, lend, sell, sublicense, redistribute or publish the App, or make it available to several devices at once over a network.
  • Remove, obscure or alter any copyright, trademark or other notice in the App.
  • Bypass, disable or tamper with the App’s purchase checks, security measures or any technical limitation, or install a modified, cracked or otherwise unauthorised copy.
  • Extract the App’s code, sounds, artwork or other content for use in another product or service, including to train machine learning models.
  • Use the App to break the law, to infringe anyone’s rights, or in any way that could harm, disable or overload a device, network or service.

Subscriptions and payments

Some features of the App require a paid subscription. Prices and billing periods are shown in the App before you buy. Payment is charged to your app store account when you confirm the purchase.

Subscriptions renew automatically at the end of each billing period unless cancelled at least 24 hours before the period ends. You can manage or cancel your subscription in your device’s account settings (on iOS: Settings › your name › Subscriptions). Deleting the App does not cancel a subscription.

Where a free trial is offered, any unused portion of the trial is forfeited when you purchase a subscription. Refunds are handled by the app store according to its policies; we cannot issue refunds directly for purchases made through Apple, and we do not receive, see or store your payment details.

A subscription unlocks features for as long as it is active. It is not a permanent purchase of those features: if the subscription lapses or is cancelled, the paid features stop working. Prices, billing periods and what a subscription includes may change; a change applies from your next billing period, and where the law requires your agreement to a price increase, we or the app store will ask for it before it takes effect.

What the App is

The App is a travel planner. You type a destination and pick your dates, and an AI model writes a day-by-day itinerary of real places with times, addresses, opening hours, cost estimates and tips, shown on a map. Around that plan the App keeps your documents, budget, notes, and the emergency numbers and embassy for the destination, and offers a currency converter, a phrasebook, country facts and a globe of your travels.

The App is a planning and organising tool. It is not a travel agency, a booking service or a tour operator: it does not make reservations, sell tickets, arrange transport or insurance, or check visa or entry requirements, and it has no relationship with any place, restaurant, hotel, airline, embassy or government it mentions. Planning happens in the cloud and needs an internet connection; the plan, once made, is stored on your phone and works offline.

The App is an independent product and is not affiliated with, endorsed by, sponsored by or approved by Apple, Anthropic, komoot, OpenStreetMap, Open-Meteo, ExchangeRate-API or any other company, place or authority whose name may appear in it.

What an AI plan can and cannot do

Please read this before you rely on a plan. The itinerary is written by an AI model from a short description of your trip, in seconds, without anyone checking it. It is a good starting point, not a verified guide, and no app can promise what a generative model will produce:

  • Places can be wrong. The model is instructed to use only real, well-known, open places, but it can still name a place that has closed, moved or been renamed, put it at the wrong coordinates, or describe it inaccurately. Check anything that matters before you set out.
  • Hours, prices and durations are estimates. Opening hours change with the season and the day, prices change, and a tip such as “book ahead” or “cash only” may be out of date. Cost estimates are rough, per person, and are not a quote.
  • The plan does not know about you. It cannot allow for your mobility, health, budget, dietary needs or travel documents, nor for the events, closures, strikes, weather and safety conditions of the actual day. It is not travel, safety, health, legal or financial advice.
  • Results vary. The same trip planned twice gives a different plan; that is what Rebuild is for. A plan you do not like is not a fault, and each plan or rebuild is a separate use of the service.
  • A plan can fail. The model can be busy, slow or unavailable, the connection can drop, or the model can decline to plan a trip, in which case the App tells you and offers to try again. Trips of one to twenty-one days can be planned.
  • You decide. Where to go, what to skip, whether a place is suitable, safe or open, and whether to follow any tip is your judgement and your responsibility.

Emergency numbers and embassy details

The emergency numbers the App shows for each country are built in and checked for the most visited destinations, but numbers change and we cannot guarantee that every number for every country is current. Embassy and consulate details — name, address, phone and website — are written by the AI model when your plan is made and may be wrong, incomplete or out of date; when the model is not confident of a number it leaves it blank rather than guess. Before you rely on either, confirm it with an official source such as your government’s foreign ministry website. If you cannot find your embassy in the App, the Find embassy button opens a web search for it.

The App is not an emergency service and does not contact one on your behalf. A Call button simply dials the number through your phone; whether the call connects depends on your phone, your carrier, your plan and the network where you are, and calls may be charged by your carrier. In a real emergency, call the local emergency number directly if the App is not to hand, and follow the instructions of the local authorities.

Weather, rates, local time and country facts

The forecast, sunrise and sunset, local time and time difference come from a third-party weather service, and the converter’s rates from a third-party rates service; both are provided as is and can be wrong, late or unavailable. The rates are indicative mid-market rates, updated at most a few times a day and shown with their age; the rate your bank, card or exchange office gives you will differ. Do not use the converter for anything where the exact rate matters.

The country facts on the Tools tab — dial code, currency, language, plug and voltage, tipping and tap water — are general guidance for the country as a whole and can be out of date or differ by region. Check official sources for anything that affects your health or safety, such as whether water is safe to drink, and carry the right adapter regardless of what the App says.

Your documents and content

You keep every right you have in the documents, photos, notes, expenses and contacts you put into the App, and in the plans and PDFs it produces for you. We claim no ownership of any of it, and — as the Privacy Policy explains — your documents never leave your phone.

The App keeps copies of your documents for convenience. It is not a substitute for carrying the originals, and it is not a backup service: if your phone is lost, broken, wiped or reset, or the App is deleted, what was in it is gone unless your own iPhone backup has it. Keep your originals, keep your phone backed up, and lock it with a passcode when it carries scans of your passport and tickets. You are responsible for the documents you attach and for making sure you have the right to store them.

Fair use of the planning service

Every plan costs us money to run, so the service limits how many plans one installation may start in an hour and how many may come from one connection. The limit is generous for normal use — planning your own trips, rebuilding a day until it looks right — and exists only to stop a runaway or automated client. You agree not to work around it, not to drive the service with anything other than the App, and not to resell access to it.

The first plan for a new trip is free once per installation, whether or not you keep the trip. Rebuilding a plan or a day, and planning a second trip, require Pro. We may change the limits, the model, the instructions we give it or the way planning works at any time, including to control cost or to improve results. If such a change makes the App substantially less useful to you, your remedy is to cancel your subscription, which you can do at any time.

Planning also depends on services we do not operate — the AI provider that runs the model, the network our own service runs on, and the search, weather and rates services the App uses. Their terms govern what they do, and the section “Services we do not control” below applies to them exactly as it does to the app store.

Free features and Pro

Your first trip and its plan, the emergency numbers for that trip, the currency converter, the phrasebook, local time and country facts, your travel statistics, and the globe with one saved place are free. Unlimited trips and plan rebuilds (the whole plan or a single day), documents, budget and expenses, unlimited saved places and PDF export require Mapia Pro, an auto-renewing subscription sold weekly or yearly. Prices are shown in the App before you buy, there is no free trial and no lifetime purchase, and the paywall first appears after your first plan is on screen — or, in one version of the introduction, at the end of it — so that you can see what the App does before paying anything.

The weekly plan exists so that you can pay for one trip only: subscribe for the trip, cancel in your Apple subscription settings when you are home, and Pro ends at the end of the week you paid for. Pro is tied to the Apple Account that made the purchase and can be restored on a new device with Restore purchases in Settings. Refunds are handled by Apple according to App Store policies.

Phrasebook

The phrasebook is a convenience for everyday situations. The translations are written by us and read aloud by your phone; they may be imperfect, formal where a local would be casual, or pronounced oddly by a synthetic voice. For anything that matters — an allergy, a medical condition, medication, a legal or police matter — do not rely on a phrase from the App alone: confirm that you have been understood, and seek a professional interpreter where one is needed.

Travelling safely and lawfully

You are responsible for your own safety and for obeying the law wherever you are. Do not read a plan, a map or the phrasebook while driving, cycling or crossing a road. Respect opening hours, private property, dress codes and local customs at the places the App suggests, and check official travel advice for your destination before you go. Where a plan suggests a hike, a swim, a night out or anything else with a risk, judge it for yourself and for the people travelling with you.

Our rights in the App

The App — its code, design, name, icon, sounds, artwork and text — belongs to us or to our licensors and is protected by copyright and trademark law. Third-party components included in the App remain the property of their authors and are used under their own licenses.

If you send us feedback, a bug report or an idea, we may use it in any way, without any obligation to you and without compensation, confidentiality or credit. Do not send us anything you want to keep confidential or be paid for.

Services we do not control

The App depends on services that are not ours, including the app store you installed it from, Apple’s or Google’s purchase systems, and RevenueCat, which validates purchases. Their own terms and privacy policies govern what they do. We are not responsible for their availability, their acts or omissions, or for any loss caused by them.

Links to other websites or apps are provided for convenience only. We do not endorse them and are not responsible for their content or practices.

Availability and changes

We may update, change or discontinue the App or any feature at any time. We will try to give reasonable notice of material changes through app store release notes.

We are under no obligation to provide updates, support, bug fixes or any particular feature, and we are not liable if the App becomes unavailable, stops working with a future operating system, or is removed from an app store. If we permanently remove a feature that your subscription paid for, your remedy is to cancel the subscription.

Disclaimer of warranties

The App is provided “as is” and “as available”, with all faults and without warranties of any kind, whether express, implied or statutory, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, quiet enjoyment or non-infringement, to the fullest extent permitted by law.

We do not warrant that the App will meet your requirements, that it will run uninterrupted, on time, securely or error-free, that defects will be corrected, or that data stored by the App will never be lost or corrupted. You use the App at your own risk, and you are responsible for keeping your own backups of anything that matters to you.

Some countries do not allow the exclusion of implied warranties, so parts of this section may not apply to you. Nothing here affects rights that the consumer law of your country gives you and does not allow to be excluded.

Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, punitive or consequential damages, or for lost profits, lost opportunities, or loss or corruption of data or content, arising out of or relating to the App — whether the claim is based on contract, tort, statute or anything else, and even if we knew such damage was possible.

To the maximum extent permitted by law, our total liability for all claims relating to the App is limited to the greater of the amount you paid us for the App in the twelve months before the claim arose and US$50.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, or for fraud, or rights under the consumer protection law of your country.

Your responsibility

If a claim is brought against us because of the way you used the App — because you broke these Terms, broke the law, or infringed someone else’s rights — you will cover the resulting losses, damages and reasonable legal costs. This does not apply to the extent the claim results from something we did, and it does not apply where the law where you live does not permit it.

Termination

You can stop using the App at any time by deleting it. We may terminate or suspend your license if you breach these Terms; if we do, you are not entitled to a refund of unused subscription time. Sections that by their nature should survive (such as our rights in the App, disclaimers and limitations of liability) survive termination.

Apple

These Terms are between you and us. Apple is not a party to them, is not responsible for the App or its content, and has no obligation to provide maintenance or support for the App.

If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App to you. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the App.

We, not Apple, are responsible for addressing any claim by you or a third party relating to the App, including product liability claims, any claim that the App fails to conform to a legal or regulatory requirement, claims under consumer protection or privacy law, and any claim that the App infringes a third party’s intellectual property rights.

You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

General

If any part of these Terms is found to be unenforceable, the rest stays in force and that part is applied as closely as possible to its original intent.

Not enforcing a term is not a waiver of it. You may not transfer your rights under these Terms; we may transfer ours if the App or our business changes hands.

These Terms, together with the Privacy Policy and the terms of the app store you installed from, are the whole agreement between you and us about the App. They are written in English; any translation is for convenience only.

Changes to these Terms

We may revise these Terms from time to time. The current version is always published on this page with its “Last updated” date. Continuing to use the App after a change means you accept the revised Terms.
